USE OF OUR WEBSITE

You may use our website exclusively to consult and to place orders legally validated.

Users may not place fraudulent, false or speculative orders.

Registering as a user is an optional requirement to acquire products from bi.lèv.

If you are a registered user, the username and password generated to permit your identification and use of our services are strictly personal and confidential. The user will be responsible to maintain its confidentiality.

The password may be modified by the user through the procedures established. The substituted password will be cancelled as identification, at the moment you generate the new one.

You may delete your account at any time.

We may block the access and the usage of our website when we estimate it is necessary for security reasons.

If you do not provide us all the necessary information, we will not be able to process your order.

When placing an order on this website, you guarantee us that you are over 18 years old and that you are legally authorized to enter into binding contracts.

The user compromises to respect the rights of Industrial and Intellectual Property ownership of bi.lèv. You may visualize our website exclusively for personal and private use.

Bi.lèv reserves the right to take any pertinent legal actions against users who violate or infringe the industrial and/or intellectual property rights.

If the website contains links to content owned by third parties, bi.lèv will not assume any responsibility whatsoever for the information contained on third party websites, nor for the information contained in it.

CONTRACT AND ORDER ACCEPTANCE

There will be no contract between you and us in relation to any product until your order has been fully verified by us. If your order is not accepted and we have charged your account, the amount will be reimbursed in its entirety.

To make a purchase you must follow the procedures to shop online. You will receive a receipt confirmation email. This does not imply that your order has been accepted, since is an offer that you are making to us for a purchase. The orders are subject to our verification and acceptance. We will confirm acceptance by sending you an email informing you that the order is being delivered (Delivery Confirmation). Only then, shall the Contract between you and us be formalized.

Only the products in relation with the Delivery Confirmation will be covered by the contract. We shall not be obliged to supply you with any other products that you may have ordered until we confirm delivery of them in a separated Delivery Confirmation.

Bi.lèv may abstain from processing orders that do not offer sufficient guarantees of solvency, or that are incomplete or incorrect, or if the bi.lèv are unavailable, with no liability assumed with you, nor with others. In any case, we are committed to keeping you informed, and if we have already charged your account for the amount of the order, we will reimburse the sum paid in advance.

PRODUCT AVAILABILITY

You accept all products offered by bi.lèv on this website are subject to stock limits. If any of the products are not available once you have placed an order, we will inform you as soon as possible. At that time, you can modify your order or cancel it.

Bi.lèv reserves the right to modify the products offered on the website at anytime without prior notice.

TRANSFER RISK AND OWNERSHIP

The user takes ownership of the bi.lèv products when you receive the shipping confirmation and the product leaves from our studio. Liability for the bi.lèv products is transferred to the user as soon as the order is delivered.

PAYMENT METHOD AND VAT

The prices on our website are shown in Euros (€) for all countries. In accordance with the applicable legislation, any purchase made on our website is subject to the Value Added Tax (VAT) or any other tax or duty applicable according to the destination country.

In case of needing an invoice, you must provide us your company details.

Bi.lèv accepts payments made via credit or debit card; AMEX, Apple Pay, Bancontact, Google Pay, Ideal, Maestro, Mastercard, Paypal, Shop Pay and Visa.

In order to protect credit or debit card payment security, we use secure payment systems. The confidential payment data are transmitted directly and encrypted (SSL) to the financial entity. When you make the payment over a secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. The issuing bank will authorize the operation.

DUTIES AND CUSTOM CHARGES

The prices within the website do not include relevant overseas duties and other customs charges you may incur. Any customs or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel.

Unfortunately we do not have control over these charges, and cannot tell you what the cost would be, as custom policies and import duties vary widely from country to country.

Please contact your local customs office for current charges before you order, so you are not surprised by charges you were not expecting.

REFUSED / ABANDONED SHIPMENTS

Bi.lèv is not responsible for refused or abandoned shipments.

If you refuse or abandon a shipment from bi.lèv, you are liable for any and all duties, taxes, original shipping charges, return shipping charges, and associated fees. This amount will be deducted from your merchandise refund.

*Please note all international custom charges and taxes are payable by the receiver. Bi.lèv is not responsible for any additional charges incurred for shipping orders internationally.

SHIPPING

All products are delivered through a courier service. Your order estimated time will be 5-8 working days within the EU and 10-15 working days to other countries, from the moment in which we have confirmed the order. Shipping arrival time is not guaranteed by bi.lèv under any circumstances as this is the responsibility of the courier service used and out of our control. In any way, our shipping policy will last 30 working days.

Once the order has left our studio, we will send an email notifying you that your order has been accepted and is being delivered.

Orders will be delivered to the delivery address that you provided on the form, so it is important there are no mistakes on the address. We will not be held liable if the delivery address is incorrect or incomplete.

For security reasons, orders will not be sent to post office boxes or military bases, nor will orders be accepted when it is impossible to identify the order recipient or their address.

PUBLIC HOLIDAYS

Bi.lèv is closed on public holidays and will not be shipping any packages.

RETURN POLICY

You have 7 days from the moment you receive your order.

In order to make any returns you must reply to the shipping confirmation email that you received when placing your order, providing us the courier service that you have used and the tracking number for your return.

Bi.lèv products must be returned in the same conditions in which you received them, together with their complete original packaging, tags and any accessory related to them. You are responsible for proving that the articles have been returned, therefore for your security and peace of mind we recommend to send items using a recorded delivery system.

Face mask returns will not be accepted for hygiene reasons.

If your return does not comply with the stipulated terms, you will not have the right to reimbursement and we will return the bi.lèv products to you, postage due or claiming for the shipping costs which will incur.

Once we have verified that the bi,lèv products that you have returned to us meet all of the specifications in the Return Policy, we will send you an email informing you that the return has been accepted. Regardless of the payment system used by you, the reimbursement will be made as soon as possible from receipt of the returned product in our studio.

We will not be liable for loss, delay or deliveries to the wrong address of any product that you want to return to us, so we recommend that you make the delivery by certified post or with receipt confirmation. You will be responsible for the product return costs, and in no case will we accept returns delivered postage due.

The delivery charges shall not be reimbursed for any reasons. The reimbursement will be made in the same paying method and to the same credit or debit card used when purchase within 15 working days.

TRACKING YOUR ORDER

You may track your order directly from our website by clicking "Track Your Order" on the Customer Care menu. Enter the tracking number provided on the shipping confirmation email.

PRODUCT GUARANTEES AND INFORMATION

The products offered on our website are carefully selected sample of bi,lèv collection.

We have taken special care in showing the colors and characteristics of our products with great precision. Of course, each monitor is calibrated differently, and we cannot guarantee that your monitor shows entirely true colors.

The designer carefully selects all garments, fabrics, embellishments and hand makes everything and/or hand-dyes each garment. Each and every piece is unique and special.

We recommend you to read the washing instructions carefully and take special care for all of our products.

All products are made in Spain.

EVENTS BEYOND OUR CONTROL

We shall not be held liable for any non-compliance or delay in compliance of any of the obligations assumed in a Contract, when the cause is due to events that are beyond our reasonable control ("Force Majeure").

Force Majeure include any act, event, lack of service, omission or accident that is beyond our reasonable control, especially including but not limited to the following:

- Strike, lockouts or other protest measures.

- Civil unrest, revolt, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.

- Fire, explosion, storm, flooding, earthquake, sinking, epidemic or any other natural disaster.

- Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private.

- Inability to use public or private telecommunication systems.

- Acts, decrees, legislation, regulations or restrictions by other governments.

Our obligation to fulfill any Contract shall be understood to be suspended during the period in which the Force Majeure situation remains in effect, and we shall be granted an extension in the period of time stipulated to fulfill our obligation while such a situation lasts. We will make every effort to bring an end to the Force Majeure situation or to find a solution by any means that enable us to fulfill our obligations under the Contract, despite the situation of Force Majeure.

APPLICABLE LEGISLATION

The use of this website and the Contract of purchasing the products on our website will be governed by Spanish Laws. To resolve any query, discrepancy or divergence, which could be caused during the completion and interpretation of this contract, parties will be subjected to the Courts and Tribunals of the city of Las Palmas de Gran Canaria (Spain).
